Filing tax return (Changed status from F1-OPT to H1B)
    Hi

    I was a F1 student from Jan 2001 to Dec 2005.
I am an Indian citizen and single
I did my OPT in Texas Tech Univ. from Dec 18 2005 to Dec 17 2006.
I got my H1B on Dec 18 2006 from TTU.
I have Fedral income tax, social security tax and medicare tax charged during 2006.

Which of the forms (1040 NR, 1040 NR-EZ, or other) should I file. Can I claim the social secuity and medicare taxes?

    Your help is appreciated

    Thanks

    Srinath,

You've had the F1 for more than 5 years, so in 2006 you became a resident. You should file 1040. You also were required to pay social security taxes in 2006 so you cannot claim that back.

Give my regards to Bob Knight.

Your annual income is projected to be LESS than $30,000.

If you are married with one or more children, you not only will NOT pay ANY income tax, you will qualify for the Earned Income Credit and a $1,000 Child Tax Credit for each child.

Now, if you are SINGLE, the lack of wthholding COULD be a problem.
