    I had surgery on c-1 c-2 fused and now have artheritis,is this a disability

    No. Are you asking about SS Disability benefits for a total disability?

    What does your Physician say?

    Yes! This could, indeed, be a disability. However, it will take a recommendation from a Specialist, a good Disability Attorney, and a little patience and persistence. The Doctors statement is the most important thing, however. If he or she believe that you can do some limited work, they will refuse to provide the mandatory statement. After I had gotten shot (long story), I begged my Physician for temporary Disability, but he wouldn't recommend it for me.

    No matter how much I begged. I am not sure if he just did this because I was young, there was some type of work that I could do, even if it means you have to chance career profession, or both. Therefore, if you are not able to carry out your daily job duties and does not have an education above high school, then you may have a chance of being approved.

    This does not always come the first time. Many of the individuals I know have been turned down at least 5 times before they got approved. So, if I were you, I would contact a Disability Attorney in the Yellow Pages and get this process started. They will probably have to make several complaints to your Physician first.

    I'm sorry but fused C-1 and 2 with accompanying arthritis do not totally disable a person - which is what is needed to collect SSD. That is why I asked what a Physician said.

    Your "5 times turn down" statement is not my experience. If the Physician's statement is strong and the papers are filled out correctly there should most definitely not be a "5 times" denied record. Without that Physician's statement there is no chance.

    Why would an Attorney make complaints to the OP's Physician?

    Perhaps this is your experience but it is not the normal.

    And my stepdaughter is a Hearing Officer for SS. She has had people who NEVER saw a Physician file for SSD based on symptoms they found on the Internet which they THOUGHT they had.

    If this is your experience it is unfortunate. How long ago was this? I don't know what you mean by you requested temporary disability. You cannot file for SSD unless the Physician states that your disability is permanent. You can, of course, be awareded benefits and attempt to return to work.
