    Accidental damage
    Who has to pay for repairs which tenant has caused (acidental) on a rental property?

    Hello k:

    Well, I'm not a solicitor, but depending on your lease and your state laws, the tenant would have to pay for them. It doesn't matter if it was an accident or not.

    "Solicitor" sounds like the UK?

    Do you have a lease? Check that. When I was a landlady, I made sure there was a paragraph that stated my tenants would pay for repairs to my property if they accidentally or on purpose caused something to break.

    Most leases won't use that language, because it's extraneous. What I mean by that is, it's obvious WHO should pay for an accident. If you drive, and somebody runs into your car, EVEN by accident, you'd want HIM to pay, wouldn't you? Of course, you would. For sure, it's not YOUR fault. Accidents happen. When they happen to you, you pay.

    Even if he were to turn it over to his insurance company, they'll come after you too.

    Accidental damage is ALWAYS the tenants responsibility where the tenant was at fault.
