I decided not to press charges now I want to, but is it too late?
About 4 months ago I was in a bar I got hit in the head with a beer mug. It left a pretty serious laceration on my head which needed staples. At the time I decided not to press charges. But now I think I want to. Is it too late to press charges?

    Hello s:

You didn't just make this decision out of the blue. Something recently happened. I know it, you know it, and the cops are going to know it.

In fact, YOU don't press charges. YOU call the cops, and THEY press charges if THEY want to - NOT YOU.

The criminal laws in this country aren't for you to use for personal reasons. If you called the cops NOW, they'd laugh at you, and might even investigate YOU.

I agree with excon. You can, however, sue in small claims court for the medical expenses and possibly pain and suffering.

The SOL would not be over, but you will have to explain to the police and maybe even the DA as to why you did not call the police the night it happened. You have your hospital report to prove it happened, and you will need witness ( not related or friends of yours) to use, such as the workers in the bar. ** but they will not want to admit there was a fight in their bar either**

So you can report it, but to be honest I doubt the do anything but a report at this point.

I will agree, all of a sudden 4 months latter you don't decide to press charges ( file a report) what has happened to cause you to want to do this.

You may sue them in court for your medical bills.
