    H1B paying taxes on W2 and 1099
    Hi,
    I am on H1-B status, i.e. I am being paid by my Employer for which I will be paying taxes on W2 Form. I got an opportunity to earn money legally for my services using 1099 form.
    Am I allowed to pay taxes for the earned income using both W2, 1099 being on H1 B status?

    I figured out the solution for this. It is not advisable to do so, the absolute legal way is that the company which is willing to give cheque on 1099 has to apply for a H1B. (i.e.Being on H1 from company A and taking H1 from another company B; keeping the H1 of A will not cause any issue in anywise. As the income from company A is declared on W2 form and income from company B is declared on 1099 from, both being on H1 status.)

    You got it correct. However, you cannot wait for the second H-1 visa if this income was earned in 2005. You need to file the tax return for 2005 ASAP.
