Hi

I just started this really nice job in a small business that has been in business for 20something years. My boss seems to have difficulties adding up minutes/hours. She insists she knows what she's doing since she has been doing this for so long. Well my paychecks are at least an hour short. I tried to talkto her multiple times with no results. She also just changes timecards without filling us in. I work flexible hours on hourly pay and I was supposed to work 4.5 hours and ended up working 6 hrs so she just scratched out 1.5 hrs. I live in California.

My question is:

Can she do this? Where do I go for help? And what would be the best approach?

If you are an hourly employee she can't do this. Try to talk to her one more time. If it doesn't work, speak with her boss. If no one of authority will correct these errors then you need to contact the state labor department.

You can report them to the state dept of labor, or sue them in small claims court if they refuse to do it correctly

You said you, "started a really nice job"... so would be a shame to see it go bad because of this.

If you put it exactly like you did above... the 4.5 hrs. you were supposed to work vs the 6 hours you did and fact that 1.5 hours was missing from the check then I am sure this person would be glad to fix the error.

If not, then you should not be working any hours that exceed the hours you were supposed to work OR this is not such a nice place to work and I think you should be seeking employment elsewhere and you should report them to the state dept. of labor as suggested by jjwoodhull and fr. Chuck.

In a diplomatic way, ask her why she scratched out the hours? Is the company having financial problems where she is only allowed to pay you for 4.5 hours. I would open the lines of communication and see what her expecations are about when you are on the clock. If you are really happy working there, hopefully you can resolve the situation peacefully.

Anyone doing payroll is not allowed to change any time without proper authorization.
