Amend tax returns for 2003, 2004
    Hi
I was on F1 status (from India) for the years 2003 & 2004. I did not detuduct my student load from my income in those 2 years.
Can I amend my 1040 NR-EZ form. Do I need a copy of my old forms. If yes how can I get it as I don't have them. Also do I need to file 8843 for those years again.

After how long am I eligible for amending my forms.

    Thanks
    Nitin

Yes, you can amend the return. If you do not have a copy of the return, contact the IRS and they will either send to a tax script for free with the necessary data or a photocopy of your Form 1040NR-EZ (they charge for the photocopy).

You have until April 15, 2007 to amend the 2003 tax return and until April 15, 2008 to amend the 2004 tax return.

ATE is right, but do you *really* want to do it? It is very complicated & time consuming matter. How much money will you save?
Note: you cannot deduct your student loan, you can only deduct student loan *interest* you paid during the year.

I paid $ 1425 in interest. Could you help me on how to calculate the amount I can deduct.

Can I just deduct 1425 from my total income before calculating my tax for the years

There is a worksheet to determine the deductible amount on http://www.irs.gov/pub/irs-pdf/i1040nr.pdf page 16

    Nitinbedi:

Vaya's guidance is accurate. Go to the worksheet to determine how much is deductible, then decide if amending the return is worth the time and effort.

I do not think you can request the previous years' tax returns via the Internet.

You have to CALL the IRS.
