    Section 8/ Hud Dilemma
    My mom died on nov of 2007. Im currently staying in her apartment with my 15 yr old sister and my 22 year old brother. My brothers name is on the lease as well as my little sisters mine is not. To make a long story short its time for my mother lease renewal and of course she can't do it because she died but I didn't tell the landlord she died because I was afraid he'd put us out because she gets hud/ section 8 assistant to pay most of her rent and then she pays the balance. How can I keep section 8 paying her portion with out lying about her death I renewed her lease last year but she was still alive when I did it for her and the landlord okayed it but what do I do this year will hud stop paying if they find out because they don't know and Im afraid if I tell him she died he will make it his business to contact hud himself and tell them and then they'll stop paying their part of the rent and then we'll be homeless what do I do?

    I think you know what the right thing to do is.

    Continuing to draw HUD benefits on behalf of a deceased person is fraud. Instead of trying to find a way to scam them further, I would be concerned of the opposite. Whenever HUD finds out (and they will) you will likely owe the money back to them. Or, I guess you could always just move out and plead ignorance. Any way you look at you'll likely be moving. Unless you can foot the entire rent yourself.

    I would not continue to commit fraud - this is a Federal offense and you could be in serious trouble. I would most definitely not recommend continuing the charade.

    Do you, your sister and brother qualify for any type of assistance? Have you researched any assistance in your own names?

    What you are doing now is called fraud, and actually all of you could end up in seroius legal trouble ( like going to jail) for this fraud of government funds, and/or they can fine each of you 10,000 or more and make you pay back all of the HUD funds paid.

    You may consider applying for the Hud and sectoin 8 yourself, since it is based on the total income of all people living there, so if you and your mother were properly reporting everyone's income, then you should still quality, ( that is of course unless they were not including everyone's incomes.)

    Or you can pay the proper rent without the Hud part being paid by them.
    Or you can merely move and find a new place to live.
