    In NYC in 1951 if a twenty-five-year old man has sexual intercourse with a fifteen or sixteen-year-old girl, is that considered rape? Is it considered rape even if the girl consents?

    Hope this info helps you out with your question, keep in mind that this is California Law that is quoted, NY may be the same if not very close to the same punishment, ifo,etc.

    Unlawful sexual intercourse is an act of sexual
    Intercourse accomplished with a person who is not the spouse of the
    Perpetrator, if the person is a minor. For the purposes of this
    A "minor" is a person under the age of 18 years and an
    "adult" is a person who is at least 18 years of age.
    Any person who engages in an act of unlawful sexual
    Intercourse with a minor who is not more than three years older or
    Three years younger than the perpetrator, is guilty of a misdemeanor.

    Any person who engages in an act of unlawful sexual
    Intercourse with a minor who is more than three years younger than
    The perpetrator is guilty of either a misdemeanor or a felony, and
    Shall be punished by imprisonment in a county jail not exceeding one
    Year, or by imprisonment in the state prison.
    (d) Any person 21 years of age or older who engages in an act of
    Unlawful sexual intercourse with a minor who is under 16 years of age
    Is guilty of either a misdemeanor or a felony, and shall be punished
    By imprisonment in a county jail not exceeding one year, or by
    Imprisonment in the state prison for two, three, or four years.
    (e) (1) Notwithstanding any other provision of this section, an
    Adult who engages in an act of sexual intercourse with a minor in
    violation of this section may be liable for civil penalties in the
    Following amounts:
    (A) An adult who engages in an act of unlawful sexual intercourse
    With a minor less than two years younger than the adult is liable for
    A civil penalty not to exceed two thousand dollars ($2,000).
    (B) An adult who engages in an act of unlawful sexual intercourse
    With a minor at least two years younger than the adult is liable for
    A civil penalty not to exceed five thousand dollars ($5,000).
    (C) An adult who engages in an act of unlawful sexual intercourse
    With a minor at least three years younger than the adult is liable
    For a civil penalty not to exceed ten thousand dollars ($10,000).
    (D) An adult over the age of 21 years who engages in an act of
    Unlawful sexual intercourse with a minor under 16 years of age is
    Liable for a civil penalty not to exceed twenty-five thousand dollars
    ($25,000).

    Confused on California sex with minor law
    Hi, I live in California and at my high school one of the teachers was accused of unlawful sex with a student who is a minor. You can read the article below. This happened on February 9, 2005.

    I looked up the in the California penal code but all it says is that if the "minor is under the age of 16" there is a certain penalty for the adult. But what if it's a minor is 16 or 17 years old, what would be the law on that? And what would be the punishment? I couldn't find anything on that. Can anyone help me with this? Is there a different law regarding unlawful intercourse with a minor that is 16 or 17 years old?


    Homestead teacher arrested on sex-with-student allegations

    A choir teacher at Homestead High School was arrested Tuesday after he and a 16-year-old female student admitted to having a two-month sexual relationship, according to the Santa Clara County Sheriff's Office.

    Brett Michael Bartlett, 25, of Campbell, was charged with oral copulation with a minor and unlawful sexual intercourse with a minor, both felonies.

    Bartlett was taken to the Main Jail in San Jose and booked without incident, authorities said.
