Can I change the locks on my roommate in New Jersey
I have a roommate since July who hasn't paid rent this month yet, It's due on the first and as of this writing it's the 13th. He is not on the lease and my super knows that but he hasn't contacted management. He also says there is nothing he can do to help. Can I have the roommate escorted off the premises for being an unwelcome guest? Can I change the locks? He told me I better not mess with his dad, threateningly. I've asked him several times for the rent each time there is an excuse, "the check should be in the mail" (his parents pay) "he's busy" or he ignores me completely. And now he wants his deposit back which I would give him after he moves out. I just want him out but I want my rent for the month. Any help for jersey tenant? He has thrown out personal items of mine (small ones but they are my things) and he still owes me for partial rent from 2 months ago.

Legally you need to give him a written notice to vacate with the amount of days that New Jersey says. Make sure you have official proof that he received it like certified mail. I believe New Jersey requires a 30 day notice. If he doesn't pay up take it to small claims court. If he pays up then he gets to stay.

You are not allowed to change the locks or remove your roommate's things. That is considered a self-help eviction and is illegal.

NJ no longer requires a written notice regarding non-payment of rent. If your roommate has not paid the rent then you can immediately go to the courthouse and file a lawsuit for eviction.
