I would like some opinions as to the possibility of winning a malpractice lawsuit. My wife has been having a very sore and inflamed throat for several weeks now. She went to her regular family doctor and he prescribed amoxicillion antibiotics for her to take. She has been taking them as prescribed with apparently no improvement in her condition. Anyway, she decided to go see an ENT specialist to get another opinion on her sore throat. This doctor took a quick look at her throat and then told her to just keep on taking what her family doctor had prescribed. He also said he wanted her to get an MRI done on her head and made an appointment for her at the hospital to get the MRI done. She is 74 years old and wondered at the time what a head MIR would show concerning her throat. Anyway, after the MIR was done she has had a problem with her right eye. The eyelid droops now and her eye in in constant pain. She also has bad headaches almost every day, which she didn't have before the MIR. This procedure was done about 2 weeks ago in Columbia, SC. I am wondering if she might possibly have grounds for a lawsuit.

You would be hard pressed to prove the MRI was the cause of your wife's headaches and drooping eye and she is 74, sounds like she had a stroke. As for fhe antibiotic, well, could not have been strong enough to take care of her cold symptoms.

Just for your information, the MRI of her head would have included her neck, above her spine. Procedure sounds quite normal to me but not knowing your wife's complete medical history, not entirely easy to judge and we don't diagnose here on AMHD.

Seeing as no part of the machinery could have come in contact with your wife, there is a question on how a injury could have occurred because that infurs physical contact.

Did they use contrast with the MRI? I don't believe that the MRI could have caused this type of symptom. It sounds more like she may have had a mini-stroke.

First I am sorry this happened, but the issue with a law suit you will have to prove, that the request for the procedure is not standard and normal ( and it is, used all the time)
Or prove that the actual procedure caused this, So you will have to get specialists to examine her and state as a fact they can prove the test caused this.

I doubt it can be proved. What is more important is to see and find the cause of the medical issue, and get it treated. It very well be that the doctor, who asked for the test may have thought of other issues, and may have been right, just caught it late.
