    Sample Eviction Notice
    I have read that once the lease expires and I want the tenant to move out, I have to give him "Notice", people have suggested doing it by registered mail. But what exactly is "notice"? Does anyone have a copy of "Notice" that they can email me? I figure it must be required to say more than,
    Dear Tenant, Get Out. Sincerely, the Landlord.

    Fourteen Day Notice Terminating Tenancy
    You are hereby notified, in any event, that your tenancy is hereby terminated as of January 25th, 2006.
    You are hereby requested to quit, vacate, and deliver possession therefore to the undersigned on or before February 8th, 2006.
    This notice to vacate is due to your following breach of tenancy:
    Damage beyond normal wear and tear to property.
    Damage that poses a potential safety hazard to you and other tenants.

    Should you fail, refuse or neglect to cure the breach, or vacate said premises within 14 days of this notice, I will take such legal action as the law requires to evict you from the premises. You are to further understand that we shall in all instances hold you responsible for all present and future rents due under the tenancy agreement.
    Any monies tendered by the tenant and accepted by the Landlord after the receipt of this notice, will be accepted for the use and occupancy only and not as rent and without in any way waiving any rights under this notice to to quit and termination notice. The landlord reserves the right to accept such monies without establishing any new tenancy. You will in any event be responsible for the use and occupancy charges for the time you occupy the premises.
    Notice is further given that failure to respond to this notice on or before the date specified in the above paragraph, shall result in due process of the law for eviction and collection of amounts due to be commenced and for other remedies available to landlord for which you will be responsible for costs and attorney fees.

    THe above is a hodge podge of stuff I put together from various sites. Does it look O.K.

    I went down to my local office supply store and bought copies of lease agreements, eviction notice, and other legal notices there.
    But I know several people who swear by the above site

    Hello new:

    Looks good to me except for the 14 day part. It would be my bet that Tennesee requires more. You can look up your states landlord tenant law at rentlaw.com

    Just my 2 cents. But what do I know, I'm a convicted felon

    It's only 14 days in TN if the tenant did damamge "beyond normal wear and tear" and is "materially affecting the safety of the property and others". :)

    The funniest part was that went the got the notice he went off on my mom, told her we were F**king crazy, he didn't rot the floor it was my mom's toilet (who lives above him) that did the damage, and if he didn't get his $300 deposit who was going to sue us and some other vague threats. Funny, the ceiling of the tenant below him leaks when he takes a shower and that is caused by my mom's toilet. I'm getting estimates today on the $$ of the damage, and I'm sure they will verify the cause.
