    Rent Increase - Proper Notice? NY State
    Hi

    I am a landlord in NY State, what is the "proper notice" for notifying my tenant of a rent increase. The off-campus housing department at William Smith Hobart college which is located in Geneva, NY states that this proper notice is a minimum of 3 days prior to the end of the month.

    Hello davidrat:

    Your tenants are either on a lease, or they are month to month. They are NOT 3 days to 3 days. In the future, I would NOT get my legal or business advice from a clerk.

    NY Law:

    "S 232-b. Notification to terminate monthly tenancy or tenancy from
    month to month outside the city of New York. A monthly tenancy or
    tenancy from month to month of any lands or buildings located outside of
    the city of New York may be terminated by the landlord or the tenant
    upon his notifying the other at least one month before the expiration of
    the term of his election to terminate; provided, however, that no
    notification shall be necessary to terminate a tenancy for a definite
    term."

    Terminate - raise the rent - it's all the same thing.

    If your tenants are on a lease you cannot raise the rent until the lease is up. You then have to offer them a renewal lease with the new terms at least 30 days prior to the expiration. If they are not on a lease then, as excon shows, you need to give them one months notice.
