    Clarifying...
    The tenant renting my property hasn't paid rent for 2 months (going into three), I've filed failure to pay rent and working on getting my rights.

    I just found out that she's
    1) trying to serve me with a peace order (i.e. so I can't contact her directly anymore, or else I get into trouble)
    2) she's filed a criminal case w/ assult/burgarly against me (she's making stuff up at this point) based on an encounter we had (was her last chance to pay before I went to court to file for non-payment of rent). Police got involved and I am going to get the report Monday (has her statement and mine). She called the police based on my request and then kicked me out of the house.

    I'm not in town and so the police can't serve me with a peace order. Hearing is Monday, so it expires Monday. What happens to that court date since I was never served? Is it just dismissed since I was never served the papers? Does that harm me in any way?

    Also, can someone advise whether I should file a separate police report about what happened that day so that I can file a criminal case against her for assult? She got physical with me and I told her to back off and asked that she call the police. How else can I get back at her for the trouble she's putting me through with all these court cases??
