    Eviction of a family member from a single family home
    My brother who is about 37 years old lives with my father, sister and myself; my brother is an alcoholic and a drug addict and is verbally abusive to my father who is 71 years old and is also disabled. My father wants him to move out of the house; is there a specific amount of time, by law, that my father has to give him to move?

    Also, if necessary how would we go about getting a restraining order against my brother?

    Generally you have to allow an evictee 30 days notice. As for the restraining order, you'd go to court and file a motion asking a judge to grant you the restraining order.

    Hello step:

    He's a tenant. You need to give him a 30 day written notice. UNLESS you can get a restraing order and that will take effect immediately.
