    Neighbors want to sell cabin that is partially on our land
    Our neighbors are selling their cabin. When they built the cabin they built it about 5 feet over the property line. They have been told several times over the years that they are on our land. We have been told now that because they have been there more than ten years it is their land and nothing we can do about it. Is this true or do we have any rights to our land?

    You NEED to get a real estate attorney on this, but the likelihood is they are right. If you were aware that the cabin was over the property line and you did not force them to move it over a period, then adverse posssession may come into play.

    What you might be able to do is force them to pay you for the land they have appropriated so that you don't block their sale.

    When the property is searched and a survey is done they will show that their house encroaches that 5 feet or so you were talking about. You will be asked to sign a Quit Claim Deed to sign them over that piece of land so that they own it free and clear. But, what you can do is make them pay a price for it. We deal with all the time at my office... but usually its:o a fence or shed built a little to far over the line.
