My sister is infecting elder abuse on my parents. She has been mentally abusing them, My parents are over 65years old and live in the state of California. They had to call the police on her 4-6 times in the last 2 month. My father is afraid of her he doesn't come out of his room and he's depressed and has to start to take medications for the depression. He sleeps all day and has no motivation to get out of bed. My sister pick fights with my parents just to get a rise out of them. We tried to evict her but it taking to long. What other options do I have . She refused to leave the home

I would suggest calling a social service or visiting nurses organization and report the problems that you have been seeing and experiencing.

What have the police suggested that you do? It would be helpful to know that.

They would have to evict her - it sounds like you have no legal standing in this matter. It could be within 30 days. If you already have the paperwork in place - you have indicated you tried to evict her - the clock is running on her tenancy.

Senior Services is sometimes helpful, also, but unless it's drastic, serious abuse, physical injuries, they also have no standing to evict her.

They can also get a protective order - I realize in some States that provides an automatic eviction; in others it's a two step process.

Unless you own the home, the parents will have to evict her. They could give you power of attorney to act on their behalf.

But she has to be given a 30 day notice and if she will not move, then she is taken to housing court.

This is the legal way to do it.

** if there is physical abuse, you call the police, and get a order of protection against her and she will have to leave the house

Good news... we went to talk to the D.A office and explained my parents situation with my sister and to advised the District Attorney of immediate threat to my parents life Something I didn't know before, my mom Caught her leaving the gas stove on one day for no reason.The main purpose was to hurt my parents , My parents felt there lives were in danger,the District Attorney agreed.
So, My parents signed the restraining order against my sister and fill out the eviction notice on a Monday, and the Judge signed the eviction notice on Tuesday , and the Sheriff came to my parents home and removed her from the home on Wednesday. She been Gone for 2 weeks and My parents are getting there life back.

Just be sure they don't let her back in.

Did the restraining order also serve to evict her or was there a separate eviction order? I've seen it work both ways and wondered what happened in this case.
