    DUE TO FORECLOSEURE
    Is there any way to get a judge to allow me time to pick up and move? I figured I had at least a month to move and was trying up to the last minute to get the money to stop the foreclosure so I haven't even started packing.

    EDIT: I have been told I have 5 days by the buyer, or he's bringing the Sheriff and a locksmith and will seize my stuff on Wednesday.

    Hello rwc:

    Eviction and foreclosure are two different things. If you've been evicted, the sheriff is on the way to put you and your things on the street. If it's only foreclosure, the bank will evict you after they take over. That'll give you a few more weeks.

    It sounds, if I am reading this correctly, as if the house's owner has had his mortgage foreclosed on. He hasn't left the house, and the person who bought it at the foreclosure sale is trying to move in. Now, for some reason the original owner was under some impression that he would have a 30-day grace period, and the new owner has made noise about 5 days to be out.

    Legally, is the original owner now a trespasser, in which case an eviction hearing wouldn't be necessary? If I'm reading the situation correctly, he wasn't a renter so no lease was involved.
