    Can I go back and refile for 1999 tax year?
    My (now ex) husband and I adopted our foster son on Feb. 1st, 1999. He had already been living with us since Sept. of 1997. My husband and I separated in June of 1999, with our son going to live with me. When it came time for me to file taxes, I filed separately but never did claim my son. Why, do you ask? My husband told me that IRS told him I could not, since he was adopted and we had gotten some state assistance with the adoption costs, due to our son's special needs. I do not know why I bought that from him, but I did not question it.

    I did not work from 2000 to 2005. In 2005 I returned to work and when it came time to file, I did claim my son. Have claimed him since. My question is, can I go back to the 1999 taxes and amend them? To claim my son? If so, how do I do that?

    It is too late to amend the return and get an additional refund, as there is a three-year statute of limitation for claiming refunds.
