    Waiver of Paternity testing.
    My son and his girlfriend sign a waiver for paternity testing. They broke up and now she wants to take him off the birth certificate and has gotten a court order to have the paternity of the child tested. He has refused to do the test, likely the child isn't his biologically yet wants to continue to be her parent. Does he have the right to refuse to test based on the waiver they both signed.

    Can a court order a paternity test when the parents both signed a waiver in the state of Colorado that says they have 60 days to contest or change and then it is permanent.

    Waiver of what? Generally one can't waive their rights away.

    Its to the advantage of both possible parents to have a test affirm paternity.

    I've merged your two threads. Did your son sign an acknowledgment of paternity? As I said, the waiver probably has no legal standing. If the mother wants to challenge your son as father she can. If she asks the court to order a test, they likely will.
