    Child support bank lien
    Hello,

I currently live in the State of Texas. I suppose to have a child in Chicago, Illinois in which I never got any DNA test done, in order to validate weather or not the child is mind. It's been well over 7 years that I left the State and moved on with my life.
While checking my account online, I noticed that I had a 0 balance on both my checking and savings account. After, calling the bank, they told me that "a lien has been placed on my account from the Illinois Department of Child Support Enforcements

I'd like to know if it's legal for them to garnish my checks here in Texas and the best cource of actions to follow.

    Thank you

Get an Attorney. For some reason, you have been deemed the legal father without a peternity test or hearing. Probably because you didn't show up for a hearing.

So now you have to find out what proceedings where held and see if you can fight them.

While Texas law prohibits garnishment of salary for unsecured debt, I believe child support can get a wage garnishment.

Yes, for child support they can take him money from the bank.

The issue is that instead of finding out, you did nothing, and the mother must have filed, could not locate you and had a court hearing without you.

So now, you get an attorney, and try to go back to court and get a DNA test done. Of course if the child is yours then you will owe the support and the current support will be changed to be based on your current income
