    If the Social Security check is your ONLY source of income, or the garnishment would cause you to drop beloew the poverty level, then the IRS cannot touch your Social Security check.

    I have a client who is in that exact situation, and we basically have laughed in the face of IRS collectors when they have periodically called and threatened to garnish her Social Security benefits.

    The internal rules within the Treasury Department prevent such garnishments as long as you can show that it would cripple you financially.

    Now, if yo have OTHER assets or sources of income that would keep you afloat financially, then the Social Security check is fair game for the IRS to collect back taxes against.

    It depends on your circumstances. If the IRS can show that you do not need the Social Security income, they can take it all.
