    Juvenile probation transfer from state to state
    My mother would like me to take custody of my 13 year old brother who is in dss custody and on juvenile probation how do we accomplish this? He is in New York I live in Pennsylvania both my mother and I agree to this decision but want to do this the right way

    PART 349
    INTERSTATE AND INTRASTATE TRANSFER OF PROBATION SUPERVISION FOR ADULTS AND JUVENILES


    §349.1 Definitions.

    (a) The term "interstate compact for parole and probation" and the "interstate compact for juveniles" means legally binding agreements and administrative arrangements under which the states in an interstate transfer serve as each other's agents in the supervision of certain parolees, probationers, juvenile delinquents and youthful offenders.

    (b) The term "interstate transfer" means a process by which the supervision of adult and child probationers is transferred to and from jurisdictions outside the State of New York.

    (c) The term "intrastate transfer" means a process by which, in the case of an adult probationer, a sentencing court or a court that by virtue of a previous transfer has assumed the powers and duties of the sentencing court and has sole jurisdiction in the case, or in the case of a child probationer, a family court designates any other probation department within the State to perform the duties of probation supervision of the probationer.

    (d) The term "temporary transfer" means the intrastate process by which supervision of a probationer who desires to reside temporarily within the jurisdiction of another local probation department for purposes of education, employment, or residential treatment is transferred to such department for a period between one and ten months.

    §349.4 Requirements for the intrastate transfers of supervision.

    (a) Any intrastate transfer must be pursuant to a designation and order of the court.

    Etc.. juvenile probation and dss
    If my little brother is both on juvenile probation and in dss custody but physically in his mothers care can she move him in with me and just transfer all necessary cases here from New York to Pennsylvania? Including turning custody over to me.

    Thank you for the help do you know if there is anyway we can expedite the process? I had my mom request a hearing with the judge to show good cause and also to get dss moving I figure the judge can do that better than my mom.. lol

    I was not asking for legal advice, I was querrying about possible ideas to expedite the process, not from people who make a living on these matters, but from people who have been through this type of situation. So, if you are going to respond with off-the-wall responses... stay away. This is serious to me, it involves a 13-year old boy!

    There is often not a lot one can do to spend things up, if the child is not currently in danger.

    Do not even attempt who will answer you and in what manner. I do notice that your posts were combined so that those of us who are experienced in these matters had a clue what you are talking about.

    If you aren't asking for legal advice, don't post on a legal thread. GV70 answered you thoroughly and took the time to research and post the law. I don't understand how/why you still have questions.

    I see no off-the-wall responses. You got info from GV that you would normally have to PAY for - and it's correct and to the point AND quotes the law. ALL family court matters are serious, no matter what the age of the children is.

    If this is such a serious matter and your question is how to expedite things, either request an emergency hearing or, better yet, retain an Attorney.

    These matters are neither quick nor easy.
