    Child abandonment laws
    Hello my name is azariah. And I wanted to know if I can file child abandonment against my ex boyfriend even if he did not sign the birth certificate

    Why do you want to file abandonment charges against the father of your child?

    Right now he's not legally the father so, no, you can't.

    I'd like to add to what the person ahead of me said. Although he didn't sign the birth certificate, if he signed a recognition of parentage or you have a DNA test that establishes him as the father you should consult your county child support enforcement agency.

    First and foremost if you haven't gotten a blood test for your child to establish who the father is. That should be your main focus. If you go to your county child support enforcement agency and request to initiate that process they will assist you. If you are a working mother they may require you to pay a small fee, and I do mean small. In my state it was $25. Start there, you'll feel better and will be initiating a process that you can be proud of. Good Luck!

    Thank You. And actually my boyfriend is the one going through this. The allege child's mother is saying that the kid is his and he is telling me that she is not his. And he claims that the mother is threating to file for child abandonment. And I just wanted to know if she can do that if he's saying that the kid isn't his. And if she isn't why is he so frightenened by the threat.

    People get frightened by the legal system, the paperwork, whatever they think is involved all the time. Maybe that's what it is; maybe he isn't 100% positive that the child is or isn't his and he's afraid to find out; maybe he's lied to you and he's afraid of getting caught.

    If you both want answers, get DNA testing done. It will open the door to support, of course, but if it really is his child...

    Does your boyfriend think he can get arrested or something for child abandonment? If so, reassure him that that is not how it works. It's not a criminal charge (unless he leaves the child at a bus stop or something). It's more a family court issue where one person argues that the other person pretty much ignores the child and they want that person's rights to see the child revoked.

    Usually doesn't work.

    I would go and get tested rather than live my life with the child's mother making threats.

    First child abandonment occurs when someone leaves a chid without care. So there is no abandonment here at all. That's ridiculous. If the mother wants to do something she should file for child support. Then a DNA test would be done to determine paternity. If your boyfriend is the father then he will likely have to pay support. He can then request visitation.

    But if the mother is threatening abandonment charges, tell him to laugh in her face. The police will if she tries.
