    Can my girlfriend lose custody of her child for living with a convicted felon? Let me start by describing my background. I have convicted of failure to re-deliver leased/hire property. What happened was I was engaged two years ago and was renting furniture and other items from a rent to own store, I came home one day from working out of state and found that my ex has wiped me clean took everything. I couldn't afford the payments by myself and I obviously couldn't give the items back so they filed charges on me. I knew I wouldn't be able to fight it so I was convicted and forced to pay back the money. Her ex is threatening her to take away her custody rights because she is dating me. Is this possible?

    For a non-violent "crime" IF you have no prior record? I highly doubt it. Of course, the father can certainly make an attempt and hope a very strict Judge hears the case.

    Hard to say without knowing more about the three of you (you, the mother, the father).

    Unless he can prove the mother unfit or you a danger to the child, its unlikely this would sway a Family Court judge to change custody.
