My husband is on probation. Can we move to another state or do we have to wait until his probation is overwith?

Hello katty:

You can get permission to move. Your husband is going to have to have a job and a place to live before he can be transferred. The other state can refuse to supervise him if they want to. Have him ask his PO.

excon has it right on the nail, you will have to ask permission to move, the state you are in has to let you go, and the state you are going to has to accept you.

Not based on that. But there's a whole lot more that they know about him that we don't. Your question should be directed at the decision maker - his PO. I'm sure he can find out with a 5 minute phone call. There is no reason to keep your desires quiet. They'll say yes, or no. If they say yes, you're in there. If they say no, you find out why, fix the problem, and apply again.

He should ask his PO what the rules are, and then ask him for a written copy. You'll be able to determine whether he's on your side or not. At least he'll know that you want to transfer, so he's not going to be surprised when he receives your request. This whole thing is about avoiding surprises.

Once he has a job and a place to live, write the probation agency that will be doing his supervision. Have him introduce himrelf. Tell them about his job, and his place to live. Tell them about his crime and how sorry he is. Tell them that you are about to request a transfer, and wanted to give them a heads up.

Then, make your request in writing to his present PO. Having read the rules, you'll KNOW that you meet the criteria. Therefore, in your request, tell them that you meet the criteria for transfer according to rule such and such... cite the rule.

A request formed in that manner will be awfully hard to turn down. If it IS turned down, you've got your ducks all lined up for an appeal.

If you're unsupervised, you still have probation rules. They're spelled out in the court order, or some other document that you signed. IF it says that you need permission to go out of state, out of the county, etc. then you need to call the probation office and ask them how to transfer unsupervised probation.
