    At this point, palying the waiting game. Attorneys have been contacted and waiting for next step. Found out that the probation department has decided to have a cut off 50ng's. Crazy.

    There is an Ohio case that contains some enlightening testimony, if it comes to that. An expected range for incidental exposure is between 300-800 according to Dr. G. Skipper, the leading expert in the field.

    See Johnson v. State Medical Board of Ohio, para 52. This is a lengthy ruling but you may want to take the time to review as it clearly sets out the fact that this test is not to be depended upon in the courts.

    The Substance Abuse and Mental Health Services Administration (SAMHSA) establishes and regulates all federally mandated drug testing programs, issued an advisory in Sept. 2006 which included the following:

    "Currently, the use of an EtG test in determining abstinence lacks sufficient proven specificity for use as primary or sole evidence that an individual prohibited from drinking, in a criminal justice or a regulatory compliance context, has truly been drinking.

    "Legal or disciplinary action based solely on a positive EtG ... is inappropriate and scientifically unsupportable at this time. These tests should currently be considered as potential valuable clinical tools, but their use in forensic settings is premature."
