    Domestic violence conviction 4th degree misdemeanor Ohio
    I was arrested on 7-24-07 for domestic violence involving a threat with a gun. I have been under house arrest since 7-24-07. I was found guilty on 8-29-07 and sentenced on 9-27-07 for a 4th degree misdemeanor. I was given a suspended sentence of 30 days jail the maximum allowed and given a 100 dollar fine plus court costs. In addition I must attend amend classes. The part I don't understand is I am still under a juris monitor device that limits me from 2 miles of my home as well as house arrest until my probation period of 18 months is over. How is this possible? Is house arrest not considered as incarceration? The max I could have received in Ohio is 30 days and a 250 dollar fine. What can I do as this seems the punishment far outweighs the crime! Any help is greatly appreciated. Thanks

    No monitoring devices is not considered incarceration, it is a diversion program basically. And you must have plead down, since normally this would have been a higher crime.
