I have a beautiful 5 year old daughter. Her biological father died. Another man signed her birth certificate but he and I split after she was two. He has not seen her or paid support not even a card in the mail. What can I do as far as stripping his rights and getting her last name changed to mine?:confused:

If he never legally adopted her then his name doesn't belong to her. Why did another man sign her birth certificate, that wasn't necessary and doesn't constitute a name change.

He doesn't have to pay child support if it isn't his child.

You should be able to file a name change on your daughters behalf without issue.

Lady B is correct. You do not have to strip his rights as he has none. Go to your local court and go to legal self help, they will be able to assist you in filling out the proper forms and you can just file them with the court. You are the only living parent so there is no issue. If you give me your state I can probably find the forms you will need.
