I need advise on the subject of my health insurance. My wife and me are separated and right now I have health insurance for her kids do I have to keep them on my plan.

If they are not your children, then no you don't, that is their father's responsibility. It would be decent of you to keep them on your insurance, and talk to her about paying their part of the premium directly to you.

Yes actually you do, or may very well, have to keep everybody on the insurance until the divorce is final. Unless you have a order directly stating that you may change any policies. I just went through the same thing and my ex-husband had to keep my children (from a different marriage) on the policy. But that is California, I suppose it could be different in your state. You really should consult your attorney to be sure. If you did your divorce pro se then you can call and ask a lawyer they will usually answer at least a few questions over the phone for free.

Talk to your HR person. If your insurance company in your state recognizes the separation as a "qualifying event" then you will be able to remove them. Our company insurance policy requires the divorce decree paperwork to be submitted along with the change paperwork.
