My daughters father has not paid any child support to me expept one $70 payment years ago. There has never been an order for it in place. She is now 6 and I live in ny. I was wodering if anyone knew how far back the court could go to make him pay? Juat wondering cause I am thinking of taking him to court.

You should still be able to take him back most of the way. ** can really vary by state the custody order and support order is issed in.
So you need to drag him back to court for not paying.

Though you should be able to take him back all the way... I don't believe you can. There was no order for support. Until there is an order he is not going to be held in arrears on child support. Basically, you dropped the ball. There may be some exceptions to this however I believe the court sees this as the father not really knowing he has a child... it isn't proven. I wouldn't waste any more time. Get a lawyer or go to child support enforcement and request an order of support be filed. Had similar problem but has been about 15 yr ago so things could have changed. It's not really fair however it's also not fair that the father hasn't been able to be a father. You might want to talk to an attorney offering free consultations. Cathy

I can remember a case where the court imposed 5 years retroactive child support.
