I would suggest calling the credit card company first and seeing if you can work out some sort of payment plan that you can afford. It worked for me. It may not be too late in their litigation process for you to do that. I would have another person on the same line on another telephone with you as a witness when you do it.

Just keep it simple.

Dear Sirs,
Please accept this as notice of my intent to defend against the suit filed against me by <insert complainant> on <insert date>. The gtounds for my defense are <insert grounds>.

Do not wait to send this as you have a limited time. After you have sent it, then you can contact the creditor and try to work out a payment schedule, if you haven't already.

If you are disputing the validity of the debt, then send a copy of the Intent to Defend to the creditor with a request that they provide documentation of the debt.
