Does any one know anything about the laws regarding naming of an infant? I would like to give my unborn child my last name(I think it would be easer for my child as well as for me); however, the father wants the child to have his last name. We are not and have never been married. I will sign an agreement of paternity, because we both agree he is the father. When the birth certificate is being filled out do I have the legal right to give my child my last name if he is adamantly against it?

I think you can name the child whatever you want. I don't know that you have to even give it your last name. You could go with baby smith.
I could be wrong - but I know when my brother and his now-wife had their son - they were not married and the child got her name.

If you are not married, you may name him what you want, if you don't list him on the birth certificate, you need to get a custody agreement and child support arranged with the father.

It is an honor for a man to give his child his last name. And it is an honor for the child as well. You know the drill, dad says, "hey buddy, us Smith's are really tough, eh boy?" In my opinion, my husband can't wait to see what becomes of his last name. You know what I mean.
