View Full Version : CA Probate, Deceased Heirs

I am ready to close a probate estate in California, but several of the heirs who are to receive money have died during the administration of the estate. Neither had ever been married or had children, and neither had any other estate assets other than this inheritance. Both lived in other states. What do I do with the deceased heirs money so that I can close my estate?

ColDan, did the two heirs die intestate (without a will)? Or did they pass with a written will ? If they passed with a will, then I wouild think any inheritance that was due them form the estate you are about to close should be distributed per their Last Will & Testament -- their may be a named charity in their will ? If so, that charity is due the assets they inherited. If they passed intestate, then I don't know. Am not an attorney but surely you have an attorney to assist you. If not, then I would consult one. You want to close this estate properly according to law and put it to bed once and forever so that it does not come back to haunt you.
