Hello,

I just eFiled my tax return for 2004 and immediately realised that I used 1040 instead of 1040NR. What do I do now? I am a student from India on F1 for the entire 2004. Any help in this matter would greatly be appreciated.

Prepare the Form 1040NR and determine if you owe more taxes using this form.

If you must pay more taxes using Form 1040NR, you must do the amendment immediately, because you must file the amendment and pay the additional taxes by this Friday. If you pay less taxes using Form 1040NR, then you have some time to work with, because there are no penalties for amending the return after the 15 April deadline if you get a refund.

You need to amend your return using Form 1040X. Explain the reason for the amendment on Page 2 of the Form 1040X/ Once you complete the amendment, attach the completed Form 1040NR and mail it to the IRS Center in Philadelphia, PA. The exact address can be found in IRS Pub 519.

Thank you for your reply. My income is too low and so I do not have to pay any tax but just claim reefund of 122 dollars. Using any of the returns is going to be the same. So, should I fill up a 1040X and also a 1040NR and send both to the address? Please help.

If you owe no taxes due to low income, then just prepare the Form 1040X with the Form 1040NR and mail it to the address listed in IRS Pub 519.
