View Full Version : Wrong offense and court date written on parking ticket

Hi,

I live in Bergen County, New Jersey. On Friday morning, 05/04/07, I dropped off my kid at the school at the usual spot and got pull over by an officer for a parking violation although I only stopped for about 1 minute. A lot of people also got issued a parking tickets yesterday morning too.

My question is the offense and the court date are wrong on this ticket:

The offense date was 04/04/07 instead of 05/04/07,
And the court date was: 05/03/07 which had already passed.

Should I go to court and ask for dismissal of this ticket? What are the chances of the judge will dismiss the ticket?

Yes you have the right to go and ask for it to be dismissed but honestly from personal expereince at least in GA and TN courts, don't expect them to, expect them to merely give you a new date, remember ( at least in our places) a ticket is merely a summons to appear in court, and can be re-issued also. Now since it is just a parking violation not a moving violation most likely they won't waste their time or bother on it, and may well drop it ( but you will have to appear before the judge to get it dismissed most likely, so you will have to get a new court date either way)

But in the courts where I was at, even listing your car wrong, the wrong color of the car and all of that won't stop the judge from honoring the ticket, ( now after court the judge will have a word with the officer about being careful)
