How does a person get his ex-girlfriend out of his legally (documents available) owned home? He has been trying since October of 2006, gave 30 day written notice to vacate and she refuses. He filed a UD, it was decided in favor of the defendant in April of 2006 stating that she is not a tenant at will and it is was a romantic relationship, not landlord/tenant. She was living with him in his home for 3 years, they are both in their forties, no commingling of funds, he paid all mortgage, property taxes, utilities and upgrades to the home and they have nothing in both of their names, not even a pest control bill. Help!

Move!

Get a new home in your name and move there, don't give her a key and sell the current home.

Maybe there is another way, but the courts are on her side in this, however they can't force you to let her into a new property. This seems to be the most quick way, but others may have another solution.

Oh, or if you like the house and this is possible, sell it to a friend or family member quietly and as is, take your stuff and put it into storage, let the friend or family member evict her and then sell you the house back.

Im sure this is more complicated than it sounds but essentially your problem is you can't make her leave as long as you own the home, I highly doubt you have to drag her along if you move so if you don't mind moving somewhere new, great, if you want to keep the house, this is a good way, at least on paper.

Maybe someone else will know this, can you sell property for $1.00 to avoid taxes etc? I saw it on a show once, is this actually possible.

If she's not a tenant, and not a guest, she's a trespasser. Call the cops.

PS> Ok, that's a little harsh. If you wish to be nice, give her notice that you're going to put her things out and change the locks in 72 hours. Then do it.

excon, thank you for your advice. It is not harsh and I believe that she is trespassing and this is a legal way to remove her. She was given notice in October of 06, UD to trial Feb of 06, denied to him April of 07 (not 06, error in my question) Tried to move her stuff in October, but she showed up and called the sheriff and they stopped the process. Thanks again.

In the end if you have tried normal court action, just change the locks on her and let her sue you in court for damages, what can she get, a few months rent at worst?

If you find a good way, please let us all know. I'm going through the same thing. Most frustrating thing I've ever been through. Good luck to us both.
