Is there a statute of limitations on making a motion to vacate a default judgment in a auto lease default ruling? How long? It's been 6 years since the judgment. I want to answer now, vacate or set aside the default judgment, and make have a chance to settle out of court now. In NY, Rockland County Supreme Court.

What and How do I do it? What are the forms. I can't afford an attorney, but I can fill forms or create forms if you just point me in the right direction.

Thanks

On what grounds do you have to set it aside, was the debt not a valid debt ? Were you not legally served ? Was the debt over the SOL period prior prior to the judgement.

While I think after 6 years you can't do anything, if you can, their has to be some legal grounds for filing a motion, you can't file one just because you want to set it aside.
And if you want to try to settle, do it, you can make them a offer to settle even with a judgement in place.
