A friend of mine is on probation for theft. He got pulled over in July 06 for driving with an open container. Is this a violation of probation?

Fr-Chuck will be able to answer this one, I bet.
However, if you look at it logically. If you are on probation then doesn't that mean not getting into trouble? Driving with an open container is against the law, right?
Has he called his Probation Officer? Better to let the PO know in advance.

No, he hasn't called his probation officer yet. He also has a warrant out for his arrest right now.

Call the PO now and advise him to turn himself in.

Hello, violatoin of probation is a vague thing at times, since it all depends on the rules you are put under, for some you can't even drink, others, traffic offenses will not violate you.
But having a warrant out for his arrest would for sure violate his probation, if he does not deal with it properly.
To stay out of trouble the best, call your probation officer inform them of everything, turn yourself in for the warrant. If you are honest with your probatoin officer many will really work with you.

Is it a violation if u have police contact and call your probation officer right after it happen?
But keep in mind that the police were not called on u they did a traffic stop and didn't give u a ticket let u go and said just contact your probation officer.. so is that a violation of federal probation
