If the other company won't accept, you only option is to go to small claims court. I'm not sure what your states laws are, in California if you don't have insurance, you will only be entitled to vehicle damages and specials damages. Which means if you are injured, you will not be entitled to pain and suffering.

If you have not made a claim with the other company, make sure you do so, if they deny, you will have to file in court.
