My roommate allowed her boyfriend to come stay with us for 2 weeks while he moved to town and got settled. He claimed he had an apartment lined up and if that didn't work he was going to live with his brother.

After a month passed of me asking when he was getting a job and when he was moving out (he played video games in her room all day) we came to the agreement that he would split the rent and utilities from Dec. until he left with us. That would mean rent + utilities/3 of us, and divided by my roommate and I knowing she wouldn't ask for the money back. My biggest mistake... trusting my friend and taking a verbal agreement only even though I didn't trust the guy.

4 months passed in which he claimed to be doing something "in a few weeks" and said that he had too much "military clearance" from his time in the Navy to get an average job such as flipping burgers. All this while he sat in her room playing online games using my internet connection, watching my cable, with my heat, and showering with my water. Obviously he was a very important guy!

On month 4 suddenly he decided that going to a casting call to be an actor/model wasn't beneath him and he claims he signed with a modeling agency and was going to be filming a commercial soon. No big surprise that hasn't happened. A week later he said he was working online transferring money from foreign countries for the state... oddly that never led to a check on my desk either and my roommate later told me he got fired because a transaction got messed up.

During this time I have two witnesses, one who heard straight from his mouth that he would pay me back every penny he owed me once he had it, and the other hearing both sides of the story from both myself and my roommate who knows full well he promised me the money. I also have at least 10 more that can also attest to the fact that he has lived here this entire time.

About a week ago he started work promoting an energy drink (again, must be good enough for his "military clearance" lol) and he stayed out all last weekend without coming back and had my roommates phone without getting a hold of her. At this point I figured he was going to bail and decided I needed a written contract. In panic I took his duffel bag from her room as leverage for him signing my agreement so he couldn't take off without confronting me. He sent people over who threatened to "whoop my " if I didn't give his bag back and broke up with my pathetic brain washed roommate who is standing up for him saying he doesn't owe me because I was "mean to him". The poor thing says she loves him and I ruined her life... just wish I could open her eyes and get what I justly deserve after all this nonsense and for living uncomfortably in my own home for 5 mo.

Do you think I have a case in small claims with just my word, a couple of witnesses, and the fact he's been unemployed with no address for 5 mo?

Even if you spent the time and money to file in small claims, pulled all your friends in as witnesses and won the case... what makes you think you would be able to get one dime out of him?? Cut your losses and move on with your life. Sorry, but I see this as a dead end.
