After being on a year lease my lease expired in aug 06 so my landlord made me month to month. I pay really low rent so the landlord doesn't fix much and the place is rundown to say the least. Recently there was a moth infestation so after badgering him he had an exterminator come but the problem wasn't fully rectified so I called him back. He got an attitude and told me he would call them back but told me I could move out w/30 day notice if I wanted at anytime because I was month to month and hung up on me! I am a single mom and can't afford to move because I am saving for surgery. So I was wondering could he legally evict me for no reason and give ME 30 days to get out? I have paid on time the entire time I have lived here and have caused no problems. What are my rights?

Yes, if you are on a month to month rental, all they have to do is give you a 30 day notice to be out, if you don't move out, then they can do formal eviction on you.

I don't think he was telling you to get out, if he said it, exactly the way you wrote it, It sounded like he was telling you, that he did not care about your problem, and was tired of your calling, and if you did not like living there you could move out.

But if he wanted you out, he would have to give you official notice to be out in 30 days. But this is what the lease is all about, a lease while it ties you into a long term, it also protects you from being kicked out normally.
