My husband and I bought a trailer and land from his brother. His other brother moved in with us. All 3 of us contributed to the household. When the trailor and land was paid for the oldest brother made the deed out to his 2 brothers leaving my name (the wife) off. My husband is an alcoholic and I want a divorce. There are no children involved and his brother has now moved out even though his name still remains on the deed. My husband continually harasses me saying my name is not on the deed so nothing belongs to me. Can anyone give me an answer as to if he is correct? Thanks in advance for any answers.

Depending on what State you live in the trailer will be community property meaning half the trailer is yours and half is your husband unless he arranges for his brother to become full owner. Check the laws in your state.

The above is true. Some states require that all assets be split 50/50, but others require that only shared property be split. That is why some people move out of state for a period of at least 6 months and reside someplace that does enforce the 50/50 split no matter what. Once you live in another state long enough you can file for divorce there.

I would check if you are on the deed. You can do this by visiting your local recording office. Whichever county your property is located is the county recorders office you want to go to or you can call a local title company and there customer service can look it up for you over the phone free of charge. To locate a title company if you don't have a phone book call a realtor or lender and they can give you a list or they'll know some that can help you

I believe in most states, property bought during a marriage is split 50/50 the difference is other states is property bought before a marriage where the percentage changes. In your situation though, your husband brother is also an owner of the home, so at most you can only have access to half of what your husband owns. If the total value of the land and trailer is worth $20,000 then you husband ownes $10,000 of the property thus if he keeps the property he will owe you $5,000.00
