14 Blue States have filed a lawsuit against Trump Musk and DOGE . The big target is Musk

"Musk's seemingly limitless and unchecked power to strip the government of its workforce and eliminate entire departments with the stroke of a pen, or a click of a mouse, would have been shocking to those who won this country's independence,"

So far she has not ruled on the temporary restraining (TRO) order request. Some suggest TROs cannot be appealed . But I don't think that has been tested when TROs conflict with Article 2 powers of the President.
Trump should take all these TROs being thrown at him by partisan judges and ask for a Fast Track expedited appeal directly to SCOTUS.

As Judge Katsas wrote in dissent of the TRO preventing Trump from removing Special Counsel Hampton Dellinger

“The extraordinary character of the order at issue here — which directs the President to recognize and work with an agency head whom he has already removed — warrants immediate appellate review,”

This is a must watch case . The future of the President being the head of the Executive Branch is at stake. Who has the say ? Partisan Judges or the President .

Filings by the Administration clarify Musk's status by Joshua Fisher Director of Office Administration
Musk is a White House 'special government employee' (SGE) as a Special Advisor to the President . He does NOT run DOGE . I wrote about special advisors above .Fisher comments about Anita Dunn in that role for Clueless Joe.

Remember Climate Czar John Kerry ? Yeah he was a special advisor too.

DOGE is a temporary White House office
Musk has NO authority to make decisions . He advises Trump and communicates Trump's directives .

Trump calls in administrators and order them to give DOGE access. They either comply ;resign or get fired .

Why is Musk involved ? He really is an expert in payment systems . He created a direct bank that became Paypal back in 1999 .

Judge Chutkan has pretty much told the states suing that she really can't prevent the Chief Executive from looking at the books . She did not quite use that language but her meaning clear

Describing the states' request for a temporary restraining order as "prophylactic," Judge Chutkan expressed skepticism about issuing a wide reaching order while the plaintiffs struggled to prove a concrete harm stemming from DOGE's conduct.
"The court can't act based on the media reports. We can't do that," Chutkan said. "The things that I'm hearing are concerning indeed and troubling indeed, but I have to have a record, and I have to make a finding on the facts before I issue something."

The judge said that in order to issue such an urgent temporary restraining order, the states would have to prove a threat of "extreme" and "imminent harm" that "can't be undone" -- and although having to "scramble to rehire" laid-off employees might be difficult and challenging, it can be done.
"I'm not seeing it so far," she said of the harms the plaintiffs are claiming.

That being said ;the firings MAY violated the government employees CBA agreement More proof that unionizing government workers is mind boggling insane.
