It's begun
Wisconsin is a swing state . Dem Guv Tony Evers vetoed a bill that would've allowed poll watchers close enough to poll counters to actually verify the count.

He also vetoed a proposal for a post election audit.

What doesn't he want poll watchers to see ?

No it isn't . We have a federal system .We don't want the executive of the nation decided by a hand full of heavily populated urban centers . The system we have now forces contenders to go from sea to sea and meet and greet the people of the country and address everyone's concerns.

The problem is not how Presidents are elected . The problem is how much power has been unconstitutionally granted to them with the creation of the administrative leviathan state ; and Congress abdicating their constitutional powers.

We are not supposed to be electing kings and dictators .

No it isn't . We have a federal systemExactly correct. It is a system that has served us well for more than two centuries.

The problem is not how Presidents are elected . The problem is how much power has been unconstitutionally granted to them with the creation of the administrative leviathan state ; and Congress abdicating their constitutional powers.Another great point. The growth of the executive is the basis of the "swamp" that Trump has referred to over and over again. The only solution is to shrink the size of that branch of government and limit its reach.

As noted ;Wisconsin is a swing state . Recognizing that ;the GOP scheduled their July convention in Milwaukee .

According to unnamed sources ;Trump was complaining about the convention being hosted by Milwaukee . He reportedly called it a "horrible city " during the GOP powwow .

A spokesperson for the Trump campaign clarified that Trump was speaking about crime in the city .

Now that SCOTUS rubber-stamped government censorship ;what does that mean for the 2024 elections ? Remember ; as long as they can censor ideas without "harming " someone then all bets are off.

Armed with this new guideline ;and with the excuse of combatting "misinformation" the various agencies of the deep state can again put the squeeze on the compliant press and social media platforms to purge opposition ideas.

Read Alito's dissent again. What he writes is spot on .
When pressured ;social media folded like cheap tents.

Fakebook's responses “were not what one would expect from an independent news source or a journalistic entity dedicated to holding the Government accountable for its actions...” “Instead, Facebook’s responses resembled that of a subservient entity determined to stay in the good graces of a powerful taskmaster.”

No doubt if Trump wins this election the Dems will again become champions of free speech.

Very disappointed with Barrett, although they are, as I understand, trying to get out the backdoor by appealing to standing. So we might assume that if another case comes forward where the client's standing is more substantial, then they might reverse this decision???

Texas has purged over 1 million names from their voter rolls.

The Slimes says no biggie . It is dead people and those who moved out of state.

Less reported was the fact that there were 6,500 non-citizens on the roll . 1,930 had a record of voting in the past.

Dems believe they can take Texas. That can only happen with the illegal vote.

Georgia .... the Dems stole that in 2020 and again in 2022. Stupid Repubs and Trump concentrated their efforts against the voting machines when video evidence proved they were stealing the vote in the time honored way of the manual count. The machines were only as trustworthy as who was feeding the machines with mail in and drop box ballots.

Georgia has sorta cleaned up their game. They recently removed 150,000 names from their rolls.

The Republican National Committee led by Michael Whatley and Lara Trump is leading a national campaign now that Ronna McDaniel (niece of Mittens Romney) has been ousted .Ronna was briefly employment by NBC after she was purged ; so you know where her loyalties were. Rachel Madcow and Chuck Todd led an effort to remove her.

This has significant risk involved with it. It is difficult to say how much longer many Americans will tolerate this blatant election cheating. It's also a reflection of how much the dems fear Donald Trump. As can be seen on this site, there are many libs who fear and hate him with considerable passion. Arizona is reporting that there are more than double the amount of voters in the state that can't prove citizenship than had been reported when SCOTUS gave then the green light to vote.

Arizona, a key swing state in November's presidential election, requires voters to prove citizenship to vote a full ballot. However, residents can still vote in federal races if they attest under penalty of perjury to being citizens.

Liberal dems have to be given some credit for old fashioned chutzpah. This is what HC says about the 2016 election.

Last month, Clinton suggested during an appearance on MSNBC that Americans accused of interfering in U.S. elections by spreading "propaganda" promoting former President Trump should be civilly or even criminally charged (https://www.foxnews.com/category/us/crime), as she cited the 2016 election in which she lost to Trump.

Amazing how the Steele Dossier has so rapidly vanished from her memory, and not to mention the participation of the FBI in squashing the HB laptop story in 2020.

But we need national action, and sadly, our Congress has been dysfunctional

WRONG !!!!! The 1st amendment is very clear .

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

She can couch her BS logic in protecting kids. That don't fly .

These social media companies can choose to self regulate any way they want to . But the government either making laws or pressuring them in any way is unconstitutional censorship .

As for 3rd party suits ; I had postings of this in the past in a number of comments .

Section 230 again (askmehelpdesk.com) (https://www.askmehelpdesk.com/current-events/section-230-again-850804.html)

Sec 230 of the Communications Decency Act protects social media platforms from the First Amendment by saying they aren’t really “publishers”. They are conduit through which posts ,tweets, etc. flow. That makes them more like utilities like telephone companies that just carry the messages ;not arbiters of what gets posted .Imagine the phone company censoring a phone conversation. That is what they want.

"No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider" In other words, host sites are protected against laws that might otherwise be used to hold them legally responsible for what others say and do.

47 U.S. Code § 230 - Protection for private blocking and screening of offensive material | U.S. Code | US Law | LII / Legal Information Institute (cornell.edu) (https://www.law.cornell.edu/uscode/text/47/230)

They can't have it both ways . If they want to be censors then they are in fact publishers of the content . If they want to claim they are not publishers then they are common carriers and do not have a right to censor. Choose one . That is what Justice Alito said in his dissent of the court's decision to stay HB20 .
Netchoice v Paxton (askmehelpdesk.com) (https://www.askmehelpdesk.com/current-events/netchoice-v-paxton-849398.html)

It is simple really .......if Twitter, Fakebook et al want to be censors, they should waive Sec 230 protections and admit they are publishers of content . Be warned then that if that is the road they want then they will have to shed any pretext of claiming to be the 21st century Town Square .

Soviet dissident Natan Sharansky said that if a person cannot walk into the middle of the town square and express his or her views without fear of arrest, imprisonment, or physical harm, then that person is living in a fear society, not a free society. I would add without fear of censorship. ("The Case for Democracy" by Natan Sharansky)

The censorship that the government actively engaged in at Twitter and other Big Tech platforms not only hurt the specific person targeted. It also is a First Amendment violation against the intended audience. In fact, that is where the main damage is done.

SCOTUS made that point clear in 1976 'Virginia Board of Pharmacy v. Virginia Citizens Consumer Council '

In a 7-to-1 opinion, the Court held that the First Amendment protects willing speakers and willing listeners equally.

Virginia State Board of Pharmacy v. Virginia Citizens Consumer Council, Inc. | Oyez (https://www.oyez.org/cases/1975/74-895)

1973 Norwood v. Harrison SCOTUS held that the government "may not induce, encourage or promote private persons to accomplish what it is constitutionally forbidden to accomplish."

This is not just true of Twitter . The government pressure on social media to restrict so called harmful content is also a clear violation . It is questionable how much censoring is voluntary and how much is induced by government pressure .

These Tech companies get a double barrel of it when government intel and law enforcement pressure them . They also are getting it from Congress demanding so called moderation.

This seems to have two concerns.

The first concerns censorship and who will be doing it. I have no doubt that liberal dems want to have their fingers on the censorship button.

But the second concerns the nature and responsibilities of the social media sites. I know that they already prohibit threats of violence or encouragement to violent activity. Not so clear on libel. Should they be censoring libelous content? That's the big question to me.

This was interesting and clearly has great significance. "They can't have it both ways . If they want to be censors then they are in fact publishers of the content . If they want to claim they are not publishers then they are common carriers and do not have a right to censor. Choose one . That is what Justice Alito said in his dissent of the court's decision to stay HB20. It would seem to say that if a social media site decides to engage in censoring content, then they are essentially taking on the role of a publisher and the legal liability associated with it. Do I have that right?

tomder55
Oct 8, 2024, 04:22 AM
Yes if they act like a publisher then they are subject to liability laws (which in the US are lax compared to the dictators in Europe) . If they are just a conduit then they are not .

It is scary that the Dems are now singing a chorus of censorship . You know their MO . Once they get in they claim a mandate to do the things they say regardless of how close the election was.

The election steal is on tour. It came to Virgina last week . As in other states run by a Repub administration ,Virgina has been cleaning up it's voter rolls by removing people no longer living in the state ;the dead ;and illegals who are registered .

But the Dems want the illegals in Virginia to vote. So they unleashed the DOJ on the state .

Office of Public Affairs | Justice Department Sues Virginia for Violating Federal Law’s Prohibition on Systematic Efforts to Remove Voters Within 90 Days of an Election | United States Department of Justice (https://www.justice.gov/opa/pr/justice-department-sues-virginia-violating-federal-laws-prohibition-systematic-efforts)

The Federal law they are using says that voter rolls need to be purged by 90 days before an election.

Guv Glenn Youngkin signed an executive order in August to clean up the Va rolls. He directed the Department of Elections to make “daily updates” to the state’s voter rolls and “remove individuals who are unable to verify that they are citizens to the Department of Motor Vehicles”.

EO-35-Comprehensive-Election-Security-Ensuring-Legal-Voters-and-Accurate-Counting---vF---8.7.24.pdf (virginia.gov) (https://www.governor.virginia.gov/media/governorvirginiagov/governor-of-virginia/pdf/eo/EO-35-Comprehensive-Election-Security-Ensuring-Legal-Voters-and-Accurate-Counting---vF---8.7.24.pdf)

Youngkin's defense against the DOJ suit is simple . These people were illegally registered to begin with and all the State is doing is correcting an illegal act . Safeguards were put in the process to avoid removing anyone who is eligible to vote.

"Every step in the established list maintenance process is mandated by Virginia law and begins after an individual indicates they are not a citizen. The DMV is mandated by law to send information about individuals who indicate they are a noncitizen in DMV transactions to (the state elections office)," Christian Martinez, a spokesman for Youngkin, said in a statement to The Associated Press (AP). "Anyone spreading misinformation about it is either ignoring Virginia law or is trying to undermine it because they want noncitizens to vote."

Lawsuit Accuses Virginia Officials of Engaging in Illegal 'Voter Purge' - Newsweek (https://www.newsweek.com/lawsuit-virginia-officials-glenn-youngkin-voter-purge-1966061)

SCOTUS already ruled that illegals registered in Arizona can vote this election .....one state Kam the Sham can claim .

In state after state audits are finding illegals registered to vote. The Dems say aint no biggie. It is few ;rare ;and doesn't impact the final outcome. We don't know that to be true. Illegals will likely swing Arizona this election (there I go again with conspiracy theories )

The non-citizen vote in Arizona 2020 was 36,000 . Clueless Joe won the state by 10,000

The Dems are in court in 3 other states besides Virginia with similar voter registration issues. In August John Roberts led SCOTUS said the state could enforce proof of citizenship laws for voting EXCEPT for about 40,000 "federal only" registered who will vote by mail but have not provided proof of citizenship.

4 years ago we were told in no uncertain terms that illegals don't vote .....that there was "no evidence " of it ;and we were conspiracy theorists for thinking such a thing.

This year ? The Joe-Kam Justice Dept is suing Virginia for illegals right to vote. As Clueless Joe says" NO JOKE !"
Now this is what is happening in VA

In an effort to clean up the rolls they sent out a questionnaire asking if they were eligible to vote . They are only removing people from the rolls who check off a box saying they are not eligible .
But what happens if the become eligible in the next 3 weeks ? Well then they can go to the polling location and fill out a provisional ballot and all they need to provide is proof they are eligible .

So the only reason for the administration to oppose it is because they want illegals to vote.

And what is happening elsewhere in the nation ?

Already mentioned to 218,000 in Arizona
Nevada 4,000 illegals voted in 2020
Oregon 1,300
Ohio 600

oh and who else has joined the lawsuit against Va ? The League of Women voters wants illegals to vote.

I was sure that the elections results this year were as they say "too big to rig " . Sad to say that is not the case nationwide.

I'm sure there are other races still undecided that may have a rigged factor involve. But here is the major one that is ongoing ;the election for Senator in Pennsylvania.

GOP candidate Dave McCormick won . Make no mistake about it . BUT Dem Bob Casey refuses to concede .

Now a recount is happening and this is where the steal could take place .

It will cost the state $2 million to recount. Casey could emerge as the victor if he got the vast majority of the provisional ballots. But in a fair recount ;that is highly unlikely.

Schmucky was going to exclude McCormick from the traditional orientation of new Senators . But he received backlash from Senators of both parties. It appears McCormick already has bipartisan support . There are Dems in the state privately urging Casey to concede . Guv Josh Shapiro has not. As a future Dem contender for the Presidency he should show leadership and tell Casey it is irresponsible to waste taxpayer money in a futile gesture.

Wow even the Compost is calling out the Pennsylvania Dems.

Opinion | Pennsylvania Democrats should not defy the state Supreme Court - The Washington Post (https://www.washingtonpost.com/opinions/2024/11/15/pennsylvania-senate-casey-provisional-ballots/)

Before the Nov. 5 election, Pennsylvania’s Supreme Court ruled that provisional ballots must be signed in two required places and that mail-in votes must be dated. Yet elected Democratic officials in Philadelphia and three other counties — Bucks, Centre and Montgomery — voted this week to defy these and other court decisions at the request of lawyers for Democratic Sen. Bob Casey, who trails GOP challenger Dave McCormick by about 24,000 votes, with almost all of the roughly 7 million ballots cast having been counted. These Democrats’ decisions will almost certainly be overturned on appeal, but the mere attempt to defy judicial rulings is corrosive to democracy and invites similar behavior in future elections.

In a stunning admission ,the Bucks County commissioner admits she knows she is defying a court order but is proceeding with the illegal recounts anyway.

Bucks County Commissioner Diane Ellis-Marseglia, a Democrat, offered this breathtaking rationalization on Thursday: “I think we all know that precedent by a court doesn’t matter anymore in this country,” she said, according to the Philadelphia Inquirer. “People violate laws anytime they want. So, for me, if I violate this law, it’s because I want a court to pay attention. There’s nothing more important than counting votes.”

First of all, "we all" actually do know that going against a clear court mandate DOES matter. Secondly, you have a government official here stating that she is violating the law and that, in her view, people do so "anytime they want." Amazingly, I doubt that anything will be done about it. So much for the rule of law. It all certainly makes Trump's protest in 2020 look a great deal more believable.

Pennsylvania's top court strikes down Dem bid to count illegal ballots as Sen. Bob Casey refuses to concede (https://nypost.com/2024/11/18/us-news/pennsylvanias-top-court-strikes-down-dem-bid-to-count-illegal-ballots-as-sen-bob-casey-refuses-to-concede/)

“SHALL COMPLY with the prior rulings of this Court in which we have clarified that mail-in and absentee ballots that fail to comply with the requirements of the Pennsylvania Election Code . . . SHALL NOT BE COUNTED” (capitalization in original).“Pa. Supreme Court again rules that Philly and other counties cannot count undated mail ballots; The ruling comes after several Philly-area counties defied the court’s previous guidance; The issue has come under close scrutiny as the race between Bob Casey and Dave McCormick undergoes a recount” - Election Law Blog (https://electionlawblog.org/?p=147336)

Justice David Wecht, a liberal wrote in concurrence;

“It is critical to the rule of law that individual counties and municipalities and their elected and appointed officials, like any other parties, obey orders of this Court. As Justice Felix Frankfurter once wrote: ‘If one man can be allowed to determine for himself what is law, every man can. That means first chaos, then tyranny. … The greater the power that defies law the less tolerant can this Court be of defiance.’”

But when you can say that a court decision can be ignored at will then you can pretty much do whatever you want .

When AP called the race for McCormick He had a 30,000 lead. The counting of provisional ballots whittled it down to around 18,000 . The only way to bring Casey over the top is counting illegal ballots or "finding" them.
