Hello,

I have a question on how to file dual status return.

We were in US for 5 years on H1b visa. Left USA permanently in June 2019. I filed a dual status return MFS. From Jan to June, I did 1040 reporting world wide income with dual status return mentioned on top of 1040. From June to dec I did not have any US sourced income to report. Should I also file a 1040 NR for the remaining part even if there is no income to report.

Do let me know.

Yes, a Form 1040NR would normally submitted as a Dual-Status Statement.

However, what you filed was a EXPATRIATE dual-status return, which means the Form 1040NR is the Dual-Status return and the Form 1040 is the Dual-Status Statement.

Your error is common, which is I constantly state that amateurs should NOT attempt to file a dual-status return.

In fact, most tax professionals should NOT file a dual-status return, as they are very tricky.
