My husband & I just moved to Iowa from California. He is a disabled Vet and our only income is his Veteran's benefits and his Social Security Disability. We live full time in our 5th wheel RV on family property. Our truck was repossessed, will be sold at auction and we will owe the difference to the finance company. At this point there are not other options to us on that issue.
If they will not accept what little payments we can afford toward the debt and are successful at securing a judgement against us, can they legally claim our RV as an asset? It is our primary residence and the only thing we own. It is only a couple years old, holds high value for an RV and is completely paid for.
I'm confident they can't garnish my husband's benefits directly. Am I correct in this? I have read that they may be able to claim them, however, if they are direct deposited, even though they are all disability benefits and veteran's benefits?
Again, we are now Iowa residents. Help? :(
