View Full Version : Should I give up my parental rights?

Well here is the thing I have a child with my ex-girlfriend and she has not allowed me to see my daughter in over a year. Now that doesn't mean that I haven't wanted to see her its just that I just now found out that she is back in town after moving out of state over a year ago against court orders. So now that I have found out she is back in town and I have contacted her she wants me to give up my rights as her father so her husband can adopt her. Her husband is a native american and can get all kinds of benefits for her because he is a native american. My daughter is a child that has a life of surgeries ahead of her. I don't want to sound like I don't want to have her on my insurance and pay my part of medical expenses. Not to mention I have always paid child support which I have no problem of paying. My ex-girlfriend has also told me that if I allow him to adopt her she will agree to post adoption visits. Well as good as that sounds cause I haven't seen her in over a year I can't be so sure that she will follow that cause she never followed our first order for me to see my daughter. So my question is this... should I give up my rights and trust that she will let me see my daughter or will I be left empty again?

That is a hard decision... I can see where you are coming from, but are you willing to give up any say in the decisions made about her medical care? If you do give up your rights, and something serious happened, you would not be able to have any power of what is done to your daughter. I have a feeling if your ex didn't abide by the court orders, why would she feel obligated to follow just a verbal agreement? I would say keep your rights and go and fight for your well deserved visitation. Your daughter will appreciate it in the end.

You will want a lawyer for this.

In some states (very very few, though) agreements between birthparents and adoptive parents are legal and binding. I'm not sure how this would work in a stepparent situation... but I'd talk to a lawyer before I signed ANYTHING, if I were you.

Please think long and hard before you do anything.It sounds like the medical care is the key to as why you would even consider this. There are other means to get help for medical care.Giving up parental rights is life long and no going back.I sure you know this.I wish you strength while you make this very hard decision.
