My daughter has both of our last names how do I drop off his? Do I need his permission?

Need more info, but I am assuming you are referring to your ex. If he has the power to make joint legal decisions, then yes you have to get his permision. (I think) Can I ask why you want to?

Of course you need!The second way is through court order but I think it will be imposible to be done.

To my knowledge.. yes you do need his permission to remove his name and what are the chances of him agreeing to that.. not likely. Ive been through the same situation I tried for years but there are no short cuts around it. If you find out more or manage to have the name changed please keep me informed, I would love to know myself. Good Luck to you!

I want to change my step-son (son) last name to mine, I am married to his mom. His father is not contesting that cause he never has been apart of his life. What do I have to do?

You do have to have consent from the non-custodial parent. In NC, for instance, the custodial parent must have the consent of the non-custodial parent, or the minor child can request a name change him/herself at age 16 (still need non-custodial consent if said parent has supported child), or a name change request can be granted if neglect/abandonment can be proven on the part of the non-custodial parent. Any which way you go, a petition has to be filed with the clerk of court (and it's not free). If the father objects to the name change, a hearing can be scheduled to hear both sides of the story; and the judge can grant a name change despite the father's objection. However, a compelling argument would have to be made as to why he/she should do so.
