My son is 17 years old, he lives with me, and has been living with me for 3 years now.. his father still has legal custody of him. . Can his father make him come live with him even though he refuses? We live in Tennessee.

In theory, yes. As long as he is a minor and the court order has him listed as such, he can. You can easily go to court and the judge will usually follow the desires of the child, he is still considered a child at 17.

I would have to ask I guess why you have not went to court to get at least temp custody after 3 years.

It is an amazing fact that if the father has legal custody and you are suppose to be paying child support, even IF the child is living with you, you still have to pay child support if you don't get the court order modified.

I have seen that happen dozen of times here in TN
The father could order you to return his son, and even file to show you in contempt in family court, and perahps even try to go for interfering with custody.
